Terms of Service

1. Acceptance of Terms

By accessing or using GAP APP ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and continued use constitutes acceptance of any changes.

2. Data Sharing and Third-Party Services

By using the Service, you acknowledge and consent to the following data sharing practices:

  • Cloud Infrastructure: Your data—including farm profiles, logs, documents, and photos—is processed and stored using third-party cloud infrastructure and database services.
  • AI and Machine Learning Providers: Certain features send your data to third-party AI model providers for processing. This includes, but is not limited to:
    • SOP generation and explanation
    • Risk analysis and farm risk assessments
    • Photo validation for compliance documentation
    • Mock audit question generation and evaluation
    • Reminder and roadmap generation
  • Auditor Link Sharing: When you generate and share auditor access links, your farm data—including facility information, SOPs, logs, documents, and compliance status—is made accessible to the recipients of those links.
  • Export and Binder Generation: Export features generate documents (PDFs, binder packages, traceability reports) that may contain your compliance data. Once exported, these documents are outside the Service's control.

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep your account information up to date. You must notify us immediately of any unauthorized use of your account.

4. Data Ownership and Licensing

You retain ownership of all data you submit to the Service, including farm profiles, logs, photos, SOPs, and documents. By using the Service, you grant GAP APP a limited, non-exclusive license to process, store, and transmit your data solely for the purpose of providing the Service and its features, including AI-powered analysis.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose, to upload malicious content, to attempt to gain unauthorized access to other users' data, or to interfere with the proper functioning of the Service. GAP APP is intended for agricultural compliance management and should be used accordingly.

6. Limitation of Liability and No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. GAP APP does not guarantee that use of the Service will result in successful GAP certification, passing an audit, or compliance with any regulation. AI-generated content (including SOPs, HACCP suggestions, risk assessments, mock audit answers, COA parsing, photo validation, and reminders) is provided as guidance only, may be incomplete or incorrect, and must be reviewed by a qualified individual before being relied on for any audit, regulatory submission, or food-safety decision. GAP APP shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, regulatory penalties, recall costs, lost product, or business interruption — arising from your use of, or inability to use, the Service.

7. Compliance Tool, Not Compliance Authority

GAP APP is a recordkeeping and workflow tool. It is not a certifying body, law firm, or regulatory authority, and nothing in the Service constitutes legal, regulatory, or food-safety advice.

  • Use of the Service does not guarantee compliance with FSMA 204 (21 CFR Part 1, Subpart S), USDA GAP, USDA Harmonized GAP, PrimusGFS, GLOBALG.A.P., the USDA National Organic Program (NOP), SCS Global Services, Whole Foods Responsibly Grown, or any other public or private standard.
  • You (the operator) remain the regulated party and are solely responsible for the accuracy, completeness, and timeliness of your records and submissions.
  • GAP APP is not affiliated with, endorsed by, or certified by the U.S. Food and Drug Administration (FDA), the U.S. Department of Agriculture (USDA), USDA Agricultural Marketing Service (AMS), or any accredited certification body.

8. Recordkeeping and Retention Responsibility

FSMA 204 and most certification programs require covered entities to retain records for defined periods (commonly two years for FSMA 204) and to produce them to regulators within a defined timeframe (FSMA 204: within 24 hours of an FDA request). You are solely responsible for meeting these obligations.

  • GAP APP provides export tooling (CSV exports, PDF reports, Export Binder, traceability reports) to assist with retention and production. You are responsible for periodically exporting your data and independently retaining off-platform copies.
  • We do not warrant uninterrupted availability of the Service or of historical data. The Service may experience downtime, data migration, archival, or feature changes.
  • Following account termination, extended inactivity, or non-payment, we may — with reasonable notice where practicable — archive, compress, restrict access to, or delete your data. Export your records before any such event.

9. Traceability Plan, KDEs, and Audit Artifacts

GAP APP captures Key Data Elements (KDEs), Critical Tracking Events (CTEs), lot codes, and related records based entirely on data you enter or upload. Accuracy of lot linkages, transformation inputs and outputs, one-up/one-down references, supplier data, and any derived report depends entirely on the data you supply.

  • Any "Traceability Plan," mock recall report, gap analysis, HACCP plan, OSP, SOP, Export Binder, or audit package generated by the Service is a template and an assembly of operator-supplied data.
  • Before being treated as your official Traceability Plan under 21 CFR 1.1315, your HACCP plan under 21 CFR Part 117 / Part 120, or as part of any audit submission, every such document must be reviewed, customized, approved, and signed by you or your qualified individual (e.g., PCQI, food safety manager, certifying agent).
  • GAP APP makes no representation that any generated artifact, as auto-produced, satisfies the requirements of any specific auditor, certification body, buyer, or regulator.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases, though we may retain certain data as required by law or for legitimate business purposes.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
